Unenforceable Contracts – What are they?
![]()
Credit Card Claims
Car Finance Claims
Mortgage & Secured Loan Claims
Unsecured Personal Loan Claims
All of the above products rely on contracts to set out their terms and conditions. When the contract was produced it should have conformed to all the appropriate laws, rules and regulations. If parts of the contract did not conform then the contract may be found to be flawed. In certain situations, such as with a credit card contract it may then be deemed to be unenforceable.
In this situation a lender would not be able to enforce repayment of any outstanding amounts; the outstanding debt could be completely written off.
When we make a claim for you, we are looking to show that a contract is unenforceable, invalid or fundamentally flawed. If a contract has financial irregularities you may be entitled to financial redress including having the balance confirmed to be unenforceable and in some cases receive compensation or for Car Finance claims you keep the vehicle!!!
Some of the many reasons our solicitors will check to ensure your credit agreement is fully compliant with UK laws and contains all the correct information correctly are;
- The full amount of the loan
- The full amount of the loan repayable with interest
- The rate of interest (APR)
- The amount of interest charged
- The cost of any PPI
- The amount payable in each instalment
- The total number of instalments to be made
- How the borrower will make the repayments
- The dates of when the agreement starts and ends
- Full terms and conditions
- Signatures from both the debtor and creditor
